Berkley Zoning Board Approves Garage and Second-Story Addition on Kipling Avenue

BERKLEY — April 10, 2023 — Berkley Zoning Board approves second variance in eight months for the same Kipling Avenue property. The Zoning Board of Appeals voted 6-0 at its April 10 meeting to grant a dimensional variance for application PBA-0123, allowing property owner Lorenzo Moline to build a two-car garage and a second-story addition at 3861 Kipling Avenue, where the proposed rear setback of 8.31 feet falls well short of the 20-foot requirement. The board found, as it did in August 2022 when it approved a first-floor laundry room and bathroom at the same address, that the lot's triangular shape constitutes a unique physical condition not of the owner's making. The board also unanimously approved edits to its rules of procedure for consistency across town boards, re-elected Chair McAlpine and Vice Chair Euler, and received a staff update that a full zoning ordinance rewrite is now underway with a steering committee that includes McAlpine.
